Section 11 AAC 67.144 - Entry permit
(a) An application for a homestead entry permit must be accompanied by an affidavit that the applicant meets the eligibility requirements of AS 38.09.030(a)(1) and AS 38.09.900(3). In addition, a nonrefundable processing fee of $5 per acre, rounded to the next highest acre if the acreage exceeds a whole number, must accompany the application.
(b) The application for an entry permit must contain the following information and any additional information required by the homestead selection procedures:
(1) the parcel's location and acreage;
(2) corner locations and a description of reference points used in locating corners;
(3) legal description of the homestead;
(4) date of staking and a description of corner stakes;
(5) names and location of adjacent entrypersons, if known;
(6) a sketch plat;
(7) the applicant's address of record where all correspondence from the department to the applicant will be mailed; and
(8) an affidavit in which the applicant attests that the applicant personally staked the corners and flagged the boundaries of the land entered, that the applicant assumes full responsibility for the accuracy of the location of the entry, and that all other actions required by the homestead selection procedures have been taken.
(c) The first applicant for a homestead entry permit to select a homestead in accordance with AS 38.09.020(b), this chapter, and the selection procedures, and to submit an application, has adjudication priority in case of later, conflicting applications for the same land. An entry permit will not be granted until the application has been adjudicated and approved by the director.
(d) An application for an entry permit may be denied for reasons including, but not limited to, the following:
(1) failure to comply with a homestead selection procedure, this chapter, or AS 38.09; or
(2) conflict with an application previously approved.

In 2010 the revisor of statutes, acting under AS 01.05.031, renumbered paragraphs in AS 38.09.900. As of Register 196 (January 2011), the regulations attorney made a conforming technical revision under AS 44.62.125(b)(6) to 11 AAC 67.144(a), so that the cross-reference to former AS 38.09.900(5) now refers to the renumbered paragraph, AS 38.09.900(3).
