Section 11 AAC 40.220 - Seeds or propagules of wild, landrace, or unknown origin(a) A registrant may not grow or replicate industrial hemp seeds or propagules of wild, landrace, or unknown origin without first obtaining written permission from the division and complying with this section. (b) Before a registrant receives written permission from the division, industrial hemp seeds or propagules subject to this section must first be grown and tested by the division after the registrant pays the fee established under 11 AAC 40.100(12). A registrant must coordinate with the division for the division's receipt of the seeds or propagules and arrange for replication and testing of mature plants grown from those seeds or propagules. (c) Following replication and testing of mature plants from industrial hemp seeds or propagules subject to this section, the division will notify the registrant whether the matured plants have passed required testing described in 11 AAC 40.600 - 11 AAC 40.665 and will approve or deny in writing the registrant's further use of the seeds or propagules, based on the results of testing.Eff. 4/4/2020, Register 234, April 2020Authority:AS 03.05.010
