On order of the Court, the application for leave to appeal the January 6, 2003 order of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the August 26, 2002 order of the Livingston Circuit Court and REMAND this case to that court for further proceedings. Neither MCR 2.410 nor 2.411 empowers a court to order a party to disclose to a mediator financial or other information, when that information is not "about the case" or "relevant to the subject matter involved in the pending action" or does not "appear reasonably calculated to lead to the discovery of admissible evidence." MCR 2.411(C)(1), MCR 2.302(B)(1), Bauroth v. Hammoud, 465 Mich. 375, 381 (2001).
We do not retain jurisdiction.
