SCHEDULING ORDER FOR SENTENCING UNDER LOCAL RULE 10.9 (GUIDELINE SENTENCING)
The sentencing of the defendant is set for Friday, June 3, 2005 at 1:00 p.m. pursuant to the following schedule:
1. If 18 U.S.C. §§ 3663-64 is applicable in this case, counsel for the government shall provide to the probation officer, no later than five days from the date of this order, all information necessary for the officer to comply with crime victim restitution requirements.
2. The Probation Officer shall make the Presentencing Investigation Report ("PSI") available to the attorneys no later than 5:00 p.m. on April 22, 2005.
3. The attorneys shall file either written objections to the PSI or written statements adopting the PSI, and deliver copies to the Court and to the Probation Officer, no later than 5:00 p.m. on May 6, 2005.
4. The Probation Officer shall — if objections to the PSI are timely filed — make the Addendum to the PSI available to the attorneys no later than 5:00 p.m. on May 13, 2005.
5. The attorneys shall file any objections to the Addendum, and deliver copies to the Court and the Probation Officer, no later than 5:00 p.m. on May 20, 2005.NOTICE TO DEFENSE ATTORNEYS : All written materials — letters, sentencing memoranda, etc. — which you want the Court to consider in connection with sentencing — must be filed and delivered to the Court and the Probation Officer at least seven (7) days prior to sentencing, i.e., by no later than 5:00 p.m. on May 27, 2005.
Because of the number of cases set for sentencing on the same day, it is difficulty if not impossible — for this Court to give careful consideration to material delivered on the day before, or the day of, sentencing.
