TEXAS DEPARTMENT OF PUBLIC SAFETY, Appellant v. M.M.C., Appellee
On Appeal from the 434th District Court Fort Bend County, Texas Trial Court Case No. 21-DCV-281103
Panel consists of Justices Kelly, Countiss, and Rivas-Molloy.
MEMORANDUM OPINION
PER CURIAM.
Appellant, Texas Department of Public Safety, appealed from the trial court's July 20, 2021 expunction order. On the motion of appellant, on February 15, 2022, this appeal was abated pending the Texas Supreme Court's decision in two similar cases. Appellant has now filed an unopposed motion to dismiss the appeal, asserting that "[f]ollowing the Texas Supreme Court's new precedent," appellee, M.M.C., "is now entitled to th[e] expunction." Thus, appellant "requests] that this appeal be dismissed." See Tex. R. App. P. 42.1(a).
No other party has filed a notice of appeal, and no opinion has issued. See Tex.R.App.P. 42.1(a)(1), (c). The certificate of conference for appellant's motion to dismiss indicates that appellee is unopposed to the motion. See Tex.R.App.P. 10.1(a)(5), 10.3(a).
Accordingly, we reinstate this appeal on the Court's active docket, grant appellant's motion, and dismiss the appeal. See Tex. R. App. P. 42.1(a), 43.2(f). All other pending motions are dismissed as moot.
