Opinion
No. 82-KA-0142.
November 5, 1982.
APPEAL FROM 22ND JUDICIAL DISTRICT COURT, PARISH OF ST. TAMMANY, STATE OF LOUISIANA, HONORABLE THOMAS W. TANNER, J.
William J. Guste, Jr., Atty. Gen., Barbara Rutledge, Asst. Atty. Gen., Marion B. Farmer, Dist. Atty., Walter P. Reed, Margaret A. Coon and Abbott J. Reeves, Asst. Dist. Attys., for plaintiff-appellee.
William J. Faustermann, Jr., Slidell, for defendant-appellant.
Because the defendant was not conscious when the trial judge announced his sentencing considerations and thus did not have a chance in the trial court to dispute the accuracy thereof, the sentence is set aside.
CONVICTION AFFIRMED; SENTENCE VACATED AND CASE REMANDED FOR RESENTENCING.
