STATE v. BROWN, Tony Lamar


Petition for review allowed in part, limited to appropriate disposition in light of Ramos v. Louisiana, 590 US ___, 140 S.Ct. 1390, 206 L Ed 2d 583 (2020); petition for review otherwise denied. The court accepts the state's concession that defendant's convictions on Counts 6, 9, 12, and 14, as well as the guilty verdict on Count 10, in Multnomah County case no. 16CR55091 and Counts 3, 4, and 5 in Multnomah County case no. 16CR62746 must be reversed. The court therefore reverses defendant's convictions on Counts 6, 9, 10, 12, and 14, and the guilty verdict on Count 10, in case no. 16CR55091 and Counts 3, 4, and 5 in case no. 16CR62746. Decision of Court of Appeals reversed in part, judgment of circuit court in case no. 16CR55091 reversed, judgment of circuit court in case no. 16CR62746 reversed, and cases remanded to circuit court for further proceedings.

Review Allowed.
