On June 28, 2024, appellant filed a motion for rehearing and en banc reconsideration of the May 15, 2024 opinion and judgment in this appeal and for extension of time to seek rehearing and en banc reconsideration. On July 9, 2024, this court denied appellant's motion.
The Honorable Patricia O. Alvarez, who was a member of the panel that decided this appeal, did not participate in the panel's or the en banc court's consideration of appellant's motions prior to her retirement effective June 30, 2024. See Tex. R. App. P. 41.2, 49.3. Justice Alvarez's successor, the Honorable Lori Massey Brissette, participated in the en banc court's consideration of appellant's motions. See id. R. 41.2.
On July 19, 2024, appellant filed a second motion seeking rehearing, en banc reconsideration, and an extension of time to seek rehearing and en banc reconsideration. After a court decides a first motion for rehearing and/or en banc reconsideration, a further motion for rehearing and/or en banc reconsideration is only permitted "if the court: (1) modifies its judgment; (b) vacates its judgment and renders a new judgment; or (c) issues a different opinion." Tex.R.App.P. 49.4, 49.6. Because the court did not modify or vacate its judgment or issue a different opinion, we DENY appellant's July 19, 2024 motion. We advise appellant that we will not consider any further motions for rehearing or en banc reconsideration.
