Smith v. Sims

Court of Appeals of Arkansas, Division I
Apr 13, 2011
2011 Ark. App. 281 (Ark. Ct. App. 2011)

Opinion

CA 10-979

Opinion Delivered April 13, 2011

Appeal from the Desha County Circuit Court, [No. CV-2008-70-3], Honorable Robert Bynum Gibson, Jr., Judge, Supplemental Addendum Ordered.

This is an appeal from a judgment in favor of appellees after a directed verdict in an action on a debt instrument. The issue is whether appellants failed to make a prima facie case. We order rebriefing because appellants' addendum is insufficient.

Arkansas Supreme Court Rule 4-2(a)(8) requires that an appellant's brief include an addendum consisting of all documents essential to the appellate court's resolution of the issues on appeal. The addendum must contain the pleadings, including the answer. Ark. Sup. Ct. R. 4-2(a)(8)(A)(i). Because appellants have not included the answer in their addendum, we direct them to correct this deficiency by filing a supplemental addendum within seven calender days from the date of this opinion. Ark. Sup. Ct. R. 4-2(b)(4). See In re 4-2(b) of the Rules of the Supreme Court, 2011 Ark. 141. We strongly encourage appellate counsel, prior to filing the supplemental addendum, to review our rules as well as the addenda to ensure that no additional deficiencies are present.
