STIPULATION TO DISMISS PETITIONER'S HABEAS PETITION WITHOUT PREJUDICE; AND ORDER


Petitioner, by and through his attorney of record, and respondents, by and through their attorneys of record, hereby stipulate, subject to the approval of the Court, to dismissal of petitioner's habeas petition without prejudice because, on March 20, 2003, the Board of Immigration Appeals vacated its March 22, 2002 summary dismissal of petitioner's appeal of an immigration judge's decision, and entered a new order dismissing petitioner's appeal.
