SOUAD SHRIME, Appellant v. LENN KAPTAIN D/B/A LENN KAPTAIN REALTORS, Appellee
On Appeal from the County Court at Law No. 4 Dallas County, Texas Trial Court Cause No. CC-18-06324-D
ORDER
ROBERT D. BURNS, III CHIEF JUSTICE
On our own motion and based on the trial court's judgment, we designate Souad Shrime as appellant/cross-appellee and Lenn Kaptain d/b/a Lenn Kaptain Realtors as appellee/cross-appellant. We DIRECT the clerk of this Court to change the style of this case as listed above.
The judgment is viewable on the trial court's website.
The clerk's record is past due. By letter dated July 9, 2021, we instructed Kaptain (then designated appellant) to provide, within ten days, written verification that payment or payment arrangements have been made to pay the clerk's fee or written documentation that he has been found to be entitled to proceed without payment of costs. Kaptain has provided written verification that on June 1, 2021, he paid $387.93 for the partial clerk's record that he requested. However, on the trial court's website are two fee notices addressed to counsel for Kaptain from the clerk's office. The first dated May 19, 2021 is a statement for $2, 221.00 for the original clerk's record. The second dated May 21, 2021 is a statement for $377.00 for the original partial clerk's record. Because the partial clerk's record has been filed, we ORDER Dallas County Clerk John Warren to file, by August 19, 2021, the partial clerk's record.
We ORDER Shrime to file, within ten days of the date of this order, written verification that she has requested a clerk's record and has paid or made arrangements to pay the clerk's fee or been found entitled to proceed without payment of costs. We caution Shrime that failure to comply may result in the dismissal of her appeal. See TEX. R. APP. P. 37.3(b).
We DIRECT the Clerk of this Court to send a copy of this order to Mr. Warren and all parties.
