ORDER

On July 11, 2024, appellant filed a motion for rehearing of the June 5, 2024 opinion and judgment in this appeal. Appellant's motion is DENIED. See Tex. R. App. P. 49.3.

The Honorable Patricia O. Alvarez, a member of the court who participated in the decision of the case, retired from this court effective June 30, 2024. She was, therefore, unable to participate in the appellant's July 11, 2024 motion for rehearing. However, since "two justices who participated in the decision of the case agree on the disposition of the motion for rehearing," there was no need for the chief justice of this court to assign a justice to replace Justice Alvarez for purposes of deciding this motion for rehearing. See Tex. R. App. P. 49.3.
