Rosenthal v. Tauber

Appellate Court of Illinois, First District
Feb 14, 1940
303 Ill. App. 652 (Ill. App. Ct. 1940)

Opinion

Gen. No. 40,807. (Abstract of Decision.)

Opinion filed February 14, 1940.

SALES, § 266action for price, directed verdict as erroneous. In action on contract for sale of certain overcoats, plaintiff made out prima facie case by showing that defendant agreed to sell the coats and dispose of the proceeds in agreed fashion, and that supplemental agreements provided for sale at public auction, and sale on consignment by defendant at a stipulated price, and lower court erred by directing verdict for defendant.

See Callaghan's Illinois Digest, same topic and section number.

Leon N. Miller, for appellant; I. J. Berkson, for appellee; Eugene A. Weinberg, of counsel.
