RHEA R. & Others v. DEPARTMENT OF CHILDREN AND FAMILIES


Further appellate review denied.

The application is denied without prejudice, and the case is remanded to the Appeals Court for consideration of the argument raised by the Department of Children and Families for the first time in its application for further appellate review — that G. L. c. 119, §§ 33B and 51E, precluded the department from disclosing the information at issue in the complaint — and for any reconsideration of its opinion that it deems necessary or advisable in light of that argument. After reconsideration by the Appeals Court, either side may apply (or reapply as the case maybe) for further review, and we will consider that application in due course.
