LUCIO PICOZZI AND PIER ALLESINA, Appellants v. MILES C. LONGSHAW, Appellee

On Appeal from the 162nd Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-14-11149

ORDER

The briefs of Lucio Picozzi and Pier Allesina were originally due July 16, 2017. To date, neither has filed a brief, but Mr. Allesina was granted an extension to August 14, 2017 and is now seeking a second extension to September 11, 2017. We GRANT Mr. Allesina's motion. Mr. Allesina's brief shall be filed by September 11, 2017. We caution Mr. Allesina that further requests for extension of time will be disfavored.

We note that when Mr. Picozzi failed to file a brief by July 16, 2017, we directed him to file, no later than July 28, 2017, the brief and an extension motion complying with Texas Rules of Appellate Procedure 10.1(a) and 10.5(b). See TEX. R. APP. P. 10. We cautioned Mr. Picozzi that failure to comply could result in dismissal of the appeal without further notice. See id. 38.8(a)(1). To date, however, Mr. Picozzi has not complied. Accordingly, we DISMISS Mr. Picozzi's appeal. See id. 38.8(a)(1), 42.3(b), (c).
