FLETCHER PETERS, Appellant v. THE STATE OF TEXAS, Appellee
On Appeal from the 5th District Court Bowie County, Texas
Trial Court No. 16-F-0827-005 Before Morriss, C.J., Moseley and Burgess, JJ. ORDER
Appellant Fletcher Peters was convicted of aggravated robbery with a deadly weapon and was sentenced to fifteen years' imprisonment. Peters appealed from that conviction and the resulting sentence. On February 13, 2018, Peters' court-appointed appellate counsel, Butch Dunbar, filed an Anders brief, and on February 22, 2018, Peters filed a pro se motion for access to the appellate record for purposes of preparing a response to his counsel's Anders brief. Under Kelly v. State, we are now required to enter an order specifying the procedure to be followed to ensure Peters' access to the record.
See Anders v. California, 386 U.S. 738 (1967).
Kelly v. State, 436 S.W.3d 313, 321-22 (Tex. Crim. App. 2014).
By letter dated February 28, 2018, this Court mailed a paper copy of the complete appellate record to Peters, absent State's Exhibit 5, which is a digital audio/video recording saved in the Audio Video Interleave (.avi) file format. By separate letter of February 28, 2018, this Court mailed a CD copy of State's Exhibit 5 to the law librarian of the Cole Unit law library, where Peters is incarcerated. Allowing a generous fifteen days for the record to be delivered to Peters and giving Peters thirty days to prepare his pro se response, we hereby set April 16, 2018, as the deadline for Peters to file his pro se response to Dunbar's Anders brief.
IT IS SO ORDERED.
