On order of the Court, the motion for rehearing is considered and, in lieu of granting rehearing, we direct the Reporter to correct the first sentence of the last paragraph of the opinion of the Court (slip op p. 13) to read as follows: "Accordingly, the judgment of the Court of Appeals is reversed, and the defendant's conviction of OUIL 2nd is reinstated." In all other respects, rehearing is DENIED.

Cavanagh, J., states: I would grant rehearing as I continue to believe that the majority's approach is likely to create substantial confusion as to what constitutes a "collateral" versus "direct" attack, and, for that matter, when the majority would have the distinction even matter.

Kelly, J., joins in the statement of Cavanagh, J.
