It is ordered that the opinion filed herein on April 5, 2011 (193 Cal.App.4th 1515;___ Cal.Rptr.3d ___), be modified in the following particulars:

On page 9, line 14 [193 Cal.App.4th 1524, advance report, 1st full par., line 1], delete the year 2010 and replace it with 2006 so the sentence reads: “Alternatively, defendant asserts the 2006 amendments to....”

On page 9, line 23 [193 Cal.App.4th 1524, advance report, 1st full par., last line], delete the year 2010 and replace it with 2006 so that the end of the sentence reads: “... a misreading of the 2006 amendments.”

There is no change in the judgment.
