Opinion

NOT TO BE PUBLISHED

Appeal from a judgment of the Superior Court of Los Angeles County No. BA321213. Norm Shapiro, Judge.

Syda Kosofsky, under appointment by the Court of Appeal, for Defendant and Appellant.

No appearance for Plaintiff and Respondent.

WEISBERG, J.

Retired Judge of the Los Angeles Superior Court, assigned by the Chief Justice pursuant to article VI, section 6 of the California Constitution.

A jury convicted appellant Oscar Richard Rodriguez of carjacking and two counts of second degree robbery. Appellant admitted allegations that he had suffered two prior serious felony convictions within the scope of Penal Code sections 667 and 1170.12 and served two prior prison terms within the scope of Penal Code section 667.5, subdivision (b). The trial court sentenced appellant, pursuant to the Three Strikes Law, to 62 years to life in prison.

Appellant demanded money from Prashanth Yalamanchili and Karthik Punikollu as they walked to Punikollu’s car outside a restaurant. Appellant held his hand under his shirt, as if he had a gun. Yalamanchili gave appellant $20. Appellant demanded that the men empty their pockets and took Punikollu’s mobile phone and car keys. Appellant ordered Punikollu to start his car, then ordered him to get out. Appellant drove away in Punikollu’s car, but was quickly arrested. Both victims identified appellant at a field show-up.

We appointed counsel to represent appellant on appeal. After examination of the record, counsel filed an opening brief raising no issues and asking this court to independently review the record. On January 15, 2009, we advised appellant he had 30 days within which to personally submit any contentions or issues he wished us to consider. To date, we have received no response.

We have examined the entire record and are satisfied that appellant’s counsel has fully complied with her responsibilities and that no arguable issues exist. (People v. Kelly (2006) 40 Cal.4th 106, 109-110; People v. Wende (1979) 25 Cal.3d 436, 441.)

DISPOSITION

The judgment is affirmed.

We concur: MALLANO, P. J., ROTHSCHILD, J.
