ORDER MODIFYING OPINION

King, J.

The opinion filed in this matter on January 16, 2008, is modified as follows:

1. On page 3, add new footnote 2 at the end of the second full paragraph as follows:

“Accordingly, we reverse the judgment against Noriega.²”

2 Judge Christian F. Thierbach presided over the trial of both defendants. Before trial, Judge Dennis A. McConaghy disqualified and ordered the removal of Noriega’s court-appointed counsel, the Riverside County Public Defender’s Office and Deputy Public Defender James Ashworth.

2. This change will necessitate renumbering the remaining footnotes.

Except for this modification, the opinion remains unchanged. This modification does not effect a change in the judgment.
