MOTION DECISION

DECISION AND ORDER ON MOTION

Motion to dismiss appeal.

Motion, pursuant to CPL 460.30, for extension of time to take appeal and to deem appeal timely taken or, in the alternative, for writ of error coram nobis.

Upon the papers filed in support of the motions and the papers filed in response to the motion for an extension of time to take an appeal and to deem the appeal timely taken or, in the alternative, for a writ of error coram nobis, it is

ORDERED that the motion to dismiss the appeal is denied without prejudice to the issues involved being raised upon the argument of the appeal, and it is further

ORDERED that the motion for an extension of time to take an appeal and to deem the appeal timely taken is denied as unnecessary (see CPL 460.10 [1] [a]), and it is further

ORDERED that the motion for a writ of error coram nobis is denied.
