Opinion

THE PEOPLE, Plaintiff and Respondent, v. JAMES LINDSAY, Defendant and Appellant. B199250 California Court of Appeal, Second District, Eighth Division January 24, 2008

NOT TO BE PUBLISHED IN THE OFFICIAL REPORTS

APPEAL from a judgment of the Superior Court of Los Angeles County, Judith Champagne, Judge, Super. Ct. No. BA283863

James M. Crawford, under appointment by the Court of Appeal, for Defendant and Appellant.

No appearance for Plaintiff and Respondent.

COOPER, P. J.

James Lindsay appeals from the judgment imposed following revocation of probation, previously granted after he pled guilty to possession of cocaine (Health & Saf. Code, § 11530, subd. (a)). He was sentenced to a term of two years.

We appointed counsel to represent appellant. On August 16, 2007, counsel filed an opening brief raising no issues. (People v. Wende (1979) 25 Cal.3d 436, 441-442.) On the same day, we advised appellant that he had 30 days within which to submit by brief or letter any grounds of appeal, contentions, or argument he wished this court to consider. No response has been received.

The record reflects that on June 2, 2005, appellant pled guilty and was placed on formal probation for three years. Probation was revoked on June 23, 2006, after appellant left a drug treatment program without permission. Probation was reinstated on November 16, 2006, following appellant’s admission of the violation. On December 15, 2006, appellant was arrested for possession of cocaine, and his probation was again revoked. On February 26, 2007, the superior court found appellant in violation of probation, and sentenced him.

We have examined the entire record, and are satisfied that appellant’s appellate counsel has fully complied with his responsibilities and that no arguable issues exist. (Smith v. Robbins (2000) 528 U.S. 259, 279-280; People v. Wende, supra, 25 Cal.3d at pp. 441, 443.)

DISPOSITION

The judgment is affirmed.

WE CONCUR: RUBIN, J., EGERTON, J.

Judge of the Superior Court of Los Angeles County, assigned by the Chief Justice pursuant to article VI, section 6 of the California Constitution.
