Opinion

THE PEOPLE, Plaintiff and Respondent, v. STEVEN RAY KARR, Defendant and Appellant. C056033 California Court of Appeal, Third District, Butte January 14, 2008

NOT TO BE PUBLISHED

Super. Ct. No. CM026506

ROBIE, J.

On February 16, 2007, Butte County Sheriff’s deputies stopped defendant Steven Ray Karr for driving without a license plate light. When they asked him to get out of the vehicle, he drove away. The deputies pursued him in their marked patrol units with lights and sirens. Defendant fled at speeds as high as 60 miles per hour in a 45-mile-per-hour zone, failing to stop at two stop signs and making numerous turns without using his turn signal.

Defendant subsequently pled no contest to violating Vehicle Code section 2800.2 in exchange for a stipulated three-year prison term, a waiver of presentence custody credits, and dismissal of an additional case. In addition to imposing the agreed-upon sentence, the court imposed restitution fines of $200 in accordance with Penal Code sections 1202.4 and 1202.45.

Defendant did not obtain a certificate of probable cause.

We appointed counsel to represent defendant on appeal. Counsel filed an opening brief that sets forth the facts of the case and requests this court to review the record and determine whether there are any arguable issues on appeal. (People v. Wende (1979) 25 Cal.3d 436.) Defendant was advised by counsel of the right to file a supplemental brief within 30 days of the date of filing of the opening brief. More than 30 days elapsed, and we received no communication from defendant. Having undertaken an examination of the entire record, we find no arguable error that would result in a disposition more favorable to defendant.

DISPOSITION

The judgment is affirmed.

We concur: SIMS, Acting P.J., NICHOLSON, J.
