NOT TO BE PUBLISHED

Santa Barbara of Superior Court County, No. 1105511, George C. Eskin, Judge.

California Appellate Project, under appointment by the Court of Appeal, Jonathan B. Steiner, Executive Director and Richard Lennon, Staff Attorney, for Appellant.

No appearance for Respondent.

YEGAN, Acting P.J.

Edward John Kakos appeals from an order revoking probation and sentencing him to two years state prison. In 2004, appellant entered a plea of no contest to abandoning/failing to maintain his minor children. (Pen. Code, § 271a). The trial court suspended imposition of sentence and granted probation with 120 days county jail.

All statutory references are to the Penal Code.

Appellant admitted violating probation in 2005 and 2006. The trial court reinstated probation with additional jail time.

In September 2006, appellant was charged with a new probation violation which appellant admitted on October 17, 2008. The trial court revoked probation and sentenced appellant to the midterm of two years state prison. Appellant was awarded 522 days presentence custody credits and ordered to pay $145,154.29 restitution to the Department of Child Support Services, a $200 restitution fine (§ 1202.4, subd. (b)), and a $200 parole revocation fine (§ 1202.45).

We appointed counsel to represent appellant in this appeal. After counsel’s examination of the record, he filed an opening brief in which no issues were raised.

On February 24, 2009, we advised appellant that he had 30 days within which to personally submit any contentions or issues he wished us to consider. We have received no response from appellant.

We have reviewed the entire record and are satisfied that appellant's attorney has fully complied with his responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The judgment is affirmed.

We concur: COFFEE, J., PERREN, J.
