Appeal by the People, as limited by their brief, from so much of an order of the County Court, Dutchess County (Forman, J.), dated October 15, 2015, as, after a hearing, granted that branch of the defendant's omnibus motion which was to suppress physical evidence.

ORDERED that the order is reversed insofar as appealed from, on the law, and that branch of the defendant's omnibus motion which was to suppress physical evidence is denied.

A police officer who saw the defendant commit two suspected violations was justified in pursuing the defendant once he fled from the officer (see People v. Morris, 138 A.D.3d 1239, 1240, 29 N.Y.S.3d 653 ; People v. Basono, 122 A.D.3d 553, 553, 997 N.Y.S.2d 415 ; People v. Caba, 78 A.D.3d 857, 858, 910 N.Y.S.2d 373 ; People v. Canty, 55 A.D.3d 330, 330–331, 864 N.Y.S.2d 426 ; People v. Simms, 25 A.D.3d 425, 808 N.Y.S.2d 64 ; People v. Delgado, 4 A.D.3d 310, 310–311, 771 N.Y.S.2d 666 ). Since the pursuit of the defendant was justified, a handgun found where the defendant fell to the ground was not subject to suppression as the product of unlawful police conduct. The County Court therefore erred in granting that branch of the defendant's omnibus motion which was to suppress physical evidence.
