ORDERED that the order is affirmed, without costs or disbursements.
The defendant's contention that he was entitled to a downward departure from his presumptive level two risk assessment is unpreserved for appellate review (see People v. Gillotti, 23 N.Y.3d 841, 861, 994 N.Y.S.2d 1, 18 N.E.3d 701 ; People v. Johnson, 11 N.Y.3d 416, 421–422, 872 N.Y.S.2d 379, 900 N.E.2d 930 ; People v. Bigelow, 175 A.D.3d 1443, 1444, 107 N.Y.S.3d 406 ; People v. Moran, 148 A.D.3d 1189, 50 N.Y.S.3d 502 ; People v. Rodriguez, 136 A.D.3d 880, 881, 24 N.Y.S.3d 914 ). In any event, the defendant's contention is without merit (see People v. Moran, 148 A.D.3d at 1189, 50 N.Y.S.3d 502 ; People v. Rodriguez, 136 A.D.3d at 881, 24 N.Y.S.3d 914 ).
Accordingly, we agree with the County Court's determination designating the defendant a level two sex offender.
