THE COURT

The opinion herein, filed on June 6, 2008, ( 163 Cal.App.4th 978; __ Cal.Rptr.3d__) is modified as follows:

On page 14, footnote 4, second paragraph of the majority opinion, the portion of the first line that states, “On appeal, defendant does not argue that . . .” should be changed and read as follows: “In supplemental letter briefing requested by this court, defendant argued that . . . .”

This modification effects no change in judgment.

Appellant’s petition for rehearing is denied.
