THE COURT

It is ordered that the opinion filed herein on March 4, 2009, be modified as follows:

The second full sentence on page 12 is modified to read as follows:

Even assuming the higher Chapman standard of harmless error applies, we are convinced beyond a reasonable doubt that trial counsel’s actions did not affect the verdict.

Chapman v. California (1967) 386 U.S. 18, 24.

Except for this modification, the opinion remains unchanged. This modification does not effect a change in judgment.
