Opinion
Gen. No. 40,811. (Abstract of Decision.)
Opinion filed February 14, 1940.
AUTOMOBILES AND MOTOR VEHICLES, § 151.1 — highway intersection accident, instruction on right of way. Where plaintiff observed a stop sign and then drove his automobile across a highway intersection, being struck by defendant's truck approaching from the right as he was almost across the intersection, and the evidence was conflicting, judgment for plaintiff would be affirmed, and instruction was proper which told jury that where vehicle entitled to right of way was so far from intersection that, both vehicles operating at lawful speed, the other car would reach the line of crossing before it would reach the intersection, such car would not have the right of way.
