ORDER CORRECTING ORDER MODIFYING OPINION

SILLS, P. J.

On October 22, 2008, this court filed an order modifying the opinion in this matter. Due to inadvertence and clerical error, the caption of the order incorrectly stated the modification did not constitute a change in judgment. Accordingly, the court’s order is CORRECTED in the following particulars:

1. On page 1, in the caption the text “Order Modifying Opinion; No Change in Judgment” is deleted and the caption is corrected so it reads: “Order Modifying Opinion; Change in Judgment.”

2. On page 2, after the text of the order the following sentence is added as a new paragraph: “This modification constitutes a change in judgment.”
