Gen. No. 41,816. (Abstract of Decision.)
Opinion filed June 1, 1942
ESTOPPEL, § 93 — as to necessity of reliance on other party's conduct. Where defendants had applied for permission to organize a bank and had subscribed for stock of the proposed bank, and the project did not materialize, they were not liable to pay for pass books printed and delivered by plaintiff where it did not make inquiry as to who would pay for the goods ordered by a third party, and there was no conduct of the defendants upon which plaintiff relied in printing and delivering the pass books.
