This case was abated and remanded to the trial court on August 22, 2023. In the abatement order, we directed the trial court to conduct a hearing to clarify whether appellant, Albert Oum Ndjock, has a right to appeal and, if necessary, to execute an amended certification of appellant's right to appeal.
On November 21, 2023, the trial court signed an amended certification of appellant's right to appeal, stating that this was "a plea-bargain case, but the trial court has given permission to appeal and [appellant] has the right of appeal." A supplemental clerk's record containing the amended certification was filed in this Court on November 21, 2023.
Accordingly, we reinstate this case on the Court's active docket. Appellant's brief is due to be filed within thirty days of the date of this order.
Appellant filed a pro se appellant's brief on August 2, 2023, prior to the completion of the appellate record. This Court strikes appellant's prematurely filed pro se brief. See Tex. R. App. P. 38.6(a); see also Landers v. State, 550 S.W.2d 272, 280 (Tex. Crim. App. 1977) (hybrid representation not permitted).
The clerk's record was filed in this case on July 11, 2023. The reporter's record was filed in this case on August 23, 2023. To the extent that appellant's appointed counsel believes that the appellate record needs to be supplemented, he may, by letter, direct the trial court clerk or the court reporter to supplement the record. See Tex. R. App. P. 34.5(c), 34.6(d).
