Opinion
Gen. No. 42,013. (Abstract of Decision.)
Opinion filed June 19, 1942
STREET RAILWAYS, § 87 — care or contributory negligence of pedestrian. Where it appeared that a pedestrian saw a street car coming about 100 feet away and rushed across the street in front of it and was struck and killed, there was no evidence tending to prove deceased was in the exercise of due care for his own safety and the trial court was justified in directing a verdict for defendant street railway.
