On the court’s own motion, it is ordered that the opinion filed herein on May 8, 2006, be modified as follows:

On page 2, footnote 2 is deleted and is replaced by the following so that it reads:

We are advised that Sundeep Bhatia owns the store in question; Jose Lomas is the president of Service. Neither Lomas, Bhatia or the store were ever named as defendants.

There is no change in the judgment.
