NEGOTIABLE INSTRUMENTS, § 140checks, time for presentment. Money orders," in writing, signed by defendant, and containing unconditional promise to pay to order of plaintiff sum certain in money, payable at named bank, are checks, and want of due presentment does not discharge drawer unless he has suffered some loss or injury thereby.

Appeal from the Municipal Court of Chicago; the Hon. GEORGE L. QUILICI, Judge, presiding.

Judgment reversed and cause remanded with directions. Heard in the second division, first district, this court at the June term, 1947.
