BERNARD J. MORELLO, Appellants v. ENTERPRISE CRUDE PIPELINE, LLC, Appellee

On Appeal from the County Court at Law No. 4 Fort Bend County, Texas Trial Court Cause No. 14-CCV-052822

Panel Consists of Justices Hassan, Poissant, and Wilson.

ORDER

PER CURIAM.

Appellant's motion for rehearing, styled as a motion for reinstatement of this appeal, is granted. This court's January 30, 2024 memorandum opinion is withdrawn, and our judgment of that date is vacated. This appeal is reinstated on the court's docket.

Appellant's motion for rehearing was filed two days after the deadline for filing a motion for rehearing. See Tex. R. App. P. 49.1. Nevertheless, the motion represents that appellant's counsel only received notice of the dismissal belatedly. We construe this motion as simultaneously requesting an extension of time to file a motion for rehearing. So construed, that request is granted.

Appellant's brief is due thirty days from the date of this order.
