Opinion
No. 10-18-00039-CV
05-30-2018
From the 12th District Court Walker County, Texas
Trial Court No. 1628082
ORDER
On April 18, 2018, Appellant filed a Motion Requesting the Reporter's Record to Be Included in the Record on This Appeal. In the motion, Appellant requests that the reporter's record "be made available for appeal" and that it be provided both to this Court and to him.
The reporter's record was subsequently filed in this Court on May 8, 2018. Furthermore, the Rules of Appellate Procedure and our Local Rules permit the temporary and conditional withdrawal of the record for the parties' use in civil cases. See TEX. R. APP. P. 12.4; 10TH TEX. APP. (WACO) LOC. R. 11. Thus, a copy of the reporter's record in this appeal may be provided to Appellant upon request.
The appellate record is now in electronic format. Appellate records are electronically received, filed, and stored. A paper copy of the reporter's record, however, will be provided to Appellant because Appellant is an inmate and we are aware that inmates generally lack access to a computer to be able to view the record in electronic format.
Accordingly, Appellant's Motion Requesting the Reporter's Record to Be Included in the Record on This Appeal is granted. The Clerk of the Court is ordered to print a copy of the reporter's record and mail it to Appellant. Moreover, because of the delay in Appellant receiving a copy of the reporter's record, Appellant's brief is not due until 30 days from the date of this Order.
Appellant's Pro Se Motion Seeking Court Intervention to Enforce Preliminary Injunction Pending Appellate Review Due to Imminent Threat to Appellant's Health and Safety, filed on April 26, 2018, is dismissed.
