Motion seeking reargument granted and, upon reargument, this Court's decision and order ( 171 A.D.2d 192) entered on October 24, 1991 is amended to the extent of deleting, from the first sentence of the second full paragraph on page 194, the words "has been assigned to another Judge", and substituting therefor the words "is no longer pending".
