RANDALL JOSEPH LEWIS, Appellant, v. THE STATE OF TEXAS, State.

Appeal from the 144th District Court of Bexar County, Texas (TC# 2024CR1984)

Before Alley, C.J., Palafox and Soto, JJ.

ORDER

PER CURIAM

Pursuant to Texas Rule of Appellate Procedure 10.4 (a), the motion or matter ruled on through this Order may have been decided by a single Justice sitting on the panel.

Pending before the Court is attorney H. Todd McCray's motion to withdraw as counsel for the Appellant stating that he has been elected to serve a term on the Fourth Court of Appeals and is unable to continue representing Appellant in this appeal. The motion is GRANTED.

Because this Court cannot appoint counsel, it is ORDERED that this appeal is abated and remanded to the trial court to appoint new counsel. The trial court shall forward its order of appointment to the District Clerk of Bexar County on or before December 16, 2024. The District Clerk shall prepare a supplemental clerk's record containing the trial court's order on or before December 26, 2024. Further, a transcription of the hearing shall be prepared, certified and filed with this Court on or before December 26, 2024. This appeal will be reinstated when the supplemental clerk's and reporter's record are filed.

IT IS SO ORDERED.
