LAZARUS FINANCIAL GROUP, INC., Appellant v. GLENN HEGAR, COMPTROLLER OF THE STATE OF TEXAS; AND KEN PAXTON, ATTORNEY GENERAL OF THE STATE OF TEXAS, Appellees

On Appeal from the 98th District Court Travis County, Texas
Trial Court Case No. D-1-GN-16-001431

MEMORANDUM OPINION

Appellant, Lazarus Financial Group, Inc., has neither established indigence for purposes of appellate costs nor made arrangements to pay the fee for preparing the clerk's record. See TEX. R. CIV. P. 145, TEX. R. APP. P. 37.3(b). After being notified that this appeal was subject to dismissal, appellant did not adequately respond. See TEX. R. APP. P. 42.3.

Pursuant to its docket equalization authority, the Supreme Court of Texas transferred this appeal from the Court of Appeals for the Third District of Texas to this Court. See Misc. Docket No. 17-9035, Transfer of Cases from Courts of Appeals (Tex. Mar. 28, 2017); see also TEX. GOV'T CODE ANN. § 73.001 (West 2013) (authorizing transfer of cases).

Accordingly, we dismiss the appeal for want of prosecution. We dismiss any pending motions as moot.

PER CURIAM Panel consists of Justices Jennings, Bland, and Lloyd.
