Gen. No. 43,160. (Abstract of Decision.)
Opinion filed November 7, 1945 Released for publication November 27, 1945
CONSPIRACY, § 4 — acts constituting conspiracy must be charged with particularity. In action charging conspiracy to defraud, where complaint contained allegations in form of conclusions with no facts given to support such conclusions, held that complaint did not state cause of action since gravamen of civil conspiracy consists of acts which constitute unlawful object of conspiracy and these must be charged with same particularity as though conspiracy were not alleged.
