LANDLORD AND TENANT, § 2 — creation and existence of relation. Where plaintiff entered into written contract with defendants for purchase of their home, and contract contained clause that possession be given plaintiff on or before ninety days from date of closing deal, and after closing deal plaintiff requested defendants to pay rent of $40 per month for ninety-day period during which defendants were to be in possession, such arrangement was construed as not creating relationship of landlord and tenant so as to entitle defendants to thirty days' notice in writing to terminate such tenancy.
