Supreme Court Case No. 21S-JV-108
03-11-2021
Published Order
This case is before the Court on Appellant's petition to transfer jurisdiction filed pursuant to Indiana Appellate Rules 56(B) and 57. After the Court of Appeals issued its memorandum decision, this Court handed down its opinion in K.C.G. v. State , 156 N.E.3d 1281 (Ind. 2020), which held that the juvenile court lacked subject matter jurisdiction to adjudicate K.C.G. a delinquent for committing the offense of dangerous possession of a firearm.
Being duly advised, the Court GRANTS transfer, VACATES the Court of Appeals memorandum decision, and REMANDS this appeal to the trial court with instructions to vacate the delinquency adjudication for Class A misdemeanor dangerous possession of a firearm.
All Justices concur.
