ORDER OF REINSTATEMENT

On July 2, 2024, the Court entered an order abating this appeal for referral to mediation. The Court further notified the parties that the appeal would remain abated until a motion was filed stating the grounds for reinstatement. On August 19, 2024, a letter was filed with the Court by the mediator, notifying the Court that the case did not settle at mediation. Further, on August 19, 2024, appellant, Carey Johnson, filed a "Motion to Retain Case on Docket." We construe appellant's motion as a motion to reinstate the appeal.

Appellant's motion does not include a certificate of conference indicating whether appellant conferred with appellee, Jon P. Herrera, regarding the relief requested in the motion. See Tex. R. App. P. 10.1(a)(5). However, more than ten days have passed and no party has filed a response to appellant's motion. See Tex. R. App. P. 10.3(a).

Appellant's motion to reinstate is granted and the appeal is reinstated on the Court's active docket.

It is so ORDERED.
