On Appeal from the 116th Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-15-14742
ORDER
Both the clerk's records and the reporter's record in this case are overdue. By order dated July 12, 2017, we denied appellant's request to proceed without payment of costs for the clerk's and reporter's records. We informed appellant that pursuant to rule 20.1 of the rules of appellate procedure, she could proceed without payment of appellate court filing fees but that whether she could proceed without payment for the appellate record was governed by rule 145 of the rules of civil procedure. On July 24, 2017, appellant filed a motion for free appellate record and statement of inability to pay in the trial court.
Accordingly, this Court ORDERS the Dallas County District Clerk to file, within THIRTY DAYS of the date of this order, either (1) the clerk's record or (2) written verification that appellant has not paid for or made arrangements to pay for the clerk's record and that appellant has not been found entitled to proceed without payment of costs. We notify appellant that if we receive verification she has not paid for or made arrangements to pay for the clerk's record and she has not been found entitled to proceed without payment of costs, we will, without further notice, dismiss the appeal. See TEX. R. APP. P. 37.3(b).
We also ORDER Renee Carroll, Official Court Reporter for the 116 Judicial District Court, to file, within THIRTY DAYS of the date of this order, either: (1) the reporter's record; (2) written verification that no hearings were recorded; or (3) written verification that appellant has not paid for or made arrangements to pay for the reporter's record and that appellant has not been found entitled to proceed without payment of costs. We notify appellant that if we receive verification no hearings were recorded or that she has not paid for or made arrangements to pay for the reporter's record and has not been found entitled to proceed without payment of costs, we will order the appeal submitted without the reporter's record. See TEX. R. APP. P. 37.3(c)
