IN RE: SUZANNE WOOD, RELATOR
AN ORIGINAL PROCEEDING IN MANDAMUS MEMORANDUM OPINION
Relator, Suzanne Wood, has filed a petition asking that we issue the writ of mandamus against the Honorable Guadalupe Rivera, Presiding Judge of the 383rd District Court of El Paso County, Texas, and order Respondent to vacate an order denying Relator's motion for emergency temporary orders in a pending divorce action. The petition for writ of mandamus and the motion for emergency relief are denied.
The divorce is styled In the Matter of the Marriage of Suzanne Wood and Reag D. Wood and in the Interest of S.M.W. and Z.M.W., Children (cause number 2016DCM0384).
To be entitled to mandamus relief, a relator generally must meet two requirements. First, the relator must show that the trial court clearly abused its discretion. In re Prudential Insurance Company of America, 148 S.W.3d 124, 135 (Tex. 2004). Second, the relator must demonstrate that there is no adequate remedy by appeal. Id. at 136. Based on the record before us, we conclude that Relator has failed to establish she is entitled to mandamus relief. Accordingly, we deny the petition for writ of mandamus and the motion for emergency relief. October 18, 2017
