IN RE Eugenio VILLARREAL

MEMORANDUM OPINION

Original Mandamus Proceeding PER CURIAM Sitting: Sandee Bryan Marion, Chief Justice Rebeca C. Martinez, Justice Liza A. Rodriguez, Justice PETITION FOR WRIT OF MANDAMUS DENIED

This proceeding arises out of Cause No. 2016CVT000921-D3, styled Tina Botello v. Sergio Guerrero, pending in the 341st Judicial District Court, Webb County, Texas, the Honorable Rebecca Ramirez Palomo presiding.

On March 19, 2020, relator filed a petition for writ of mandamus. Relator also filed a motion for stay of the underlying proceedings pending final resolution of the petition for writ of mandamus, which this court granted on March 24, 2020. On April 27, 2020, the real party in interest filed a response in which she requested that relator be sanctioned. After considering the petition, the response, and the record, this court concludes relator is not entitled to the relief sought. Accordingly, the petition for writ of mandamus is denied. See TEX. R. APP. P. 52.8(a). The stay imposed on March 24, 2020 is lifted. The real party in interest's request for sanctions is denied.
