ORDER
On May 4, 2017, appellee filed a brief that is not in compliance with the Texas Rules of Appellate Procedure. The brief fails to comply with Rule 9.4. See Tex. R. App. P. 9.4. Specifically, approximately fifty-five pages of the brief (about 40%) consists of images of text copied from the reporter's record and the clerk's record. These images are not searchable and are not in 14-point type. See Tex. R. App. P. 9.4(e), (j)(1). Moreover, in accordance with Rule 9.4(i)(1), the words contained in these images are to be included in calculating the length of the document. See Tex. R. App. P. 9.4(i)(1).
Accordingly, we permit appellee to resubmit his brief in a conforming format within thirty (30) days of the date of this order. See Tex. R. App. P. 9.4(k). If appellee files another nonconforming brief, the Court may strike the brief. Id.
Although the rules do not address it, we request appellee refrain from highlighting any text.
If appellee files a conforming brief, appellant may filed an amended reply brief within twenty (20) days of the date appellee's brief is filed.
