Original Mandamus Proceeding.

This proceeding arises out of Cause No. 2003-CR-1873, styled State v. Vargas, pending in the 144th Judicial District Court, Bexar County, Texas, the Honorable Mark Luitjen presiding.

Petition for Writ of Mandamus Denied As Moot.

MEMORANDUM OPINION


Francisco Javier Vargas filed a petition for a writ of mandamus complaining of the trial court's failure to complete sentencing in the underlying cause. On November 29, 2005, this court abated the related appeal and remanded the matter to the trial court. On January 11, 2006, the trial court held a sentencing hearing. A reporter's record from this hearing and a supplemental clerk's record containing the revised judgments have been filed with this court in the related appeal. Accordingly, relator's petition for a writ of mandamus is DENIED as moot.

Cause Number 04-04-00901-CR.
