Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, Donna Valverde, filed a petition for writ of mandamus challenging the trial court's August 25, 2020 order compelling relator to "make herself available and appear for her deposition before October 1, 2020." Relator also filed an "Emergency Motion to Stay" requesting that this Court stay her deposition pending resolution of her petition for writ of mandamus. On September 28, 2020, the Court denied relator's request for emergency relief. Relator has filed an unopposed motion to dismiss her petition for writ of mandamus.

The underlying case is In the Estate of Helen Fricks Valverde, Deceased, Cause No. 431,447-401, in the Probate Court No. 3 of Harris County, Texas, the Honorable Jason Cox presiding.

Accordingly, we grant relator's motion and dismiss the petition. We dismiss all pending motions as moot.
